Terms of Service
Important: Please read these Terms carefully before using WA Recall. By downloading or using the app, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Pinchus Grosz ("Developer," "we," "us," or "our") governing your use of the WA Recall iOS application and associated server service (collectively, the "Service").
By creating an account, downloading the app, or using the Service in any way, you confirm that you are at least 13 years of age (or 16 in the EU), have read and understood these Terms, and agree to be bound by them.
2. Description of Service
WA Recall is a personal WhatsApp message archiving application that captures, stores, and organizes your WhatsApp messages — including deleted and edited messages — on a private server associated with your account. The Service allows you to:
- Archive WhatsApp messages, media, and status updates in real time
- Search and browse your complete message history
- View deleted and edited messages
- Back up your archive to iCloud
- Export your message data
WA Recall is intended for personal use only. You may only archive messages from WhatsApp accounts that you own and control.
3. Subscriptions and Billing
3.1 Subscription Plans
WA Recall requires an active paid subscription to use the Service. The following plans are available through the Apple App Store:
- Weekly Plan: Access to all features, billed weekly
- Annual Plan: Access to all features, billed annually at a discounted rate
3.2 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the original purchase.
3.3 Managing Subscriptions
You can manage or cancel your subscription at any time through your iPhone Settings: tap your name → Subscriptions → WA Recall. Cancellation takes effect at the end of the current billing period; you will retain access until that date.
3.4 Free Trial
If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.
3.5 Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple directly through the App Store. We do not process refunds directly. Apple's refund policies apply.
3.6 Price Changes
We reserve the right to change subscription prices. Price changes will take effect at the start of the next subscription period following notice to you. Your continued use of the Service after a price change constitutes acceptance of the new price.
4. Account Registration and Security
To use WA Recall, you must create an account with a valid email address and link your WhatsApp account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your account information is accurate and up to date
You may not share your account with others or create multiple accounts for the same WhatsApp number. We reserve the right to terminate accounts that violate these Terms.
5. Acceptable Use
You agree to use WA Recall only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service to archive messages from WhatsApp accounts you do not own
- Use the Service to surveil, monitor, or spy on other individuals without their knowledge and consent
- Use the Service for any illegal purpose, including but not limited to wiretapping, unauthorized interception of communications, or stalking
- Attempt to reverse engineer, decompile, or extract the source code of the app
- Use the Service to transmit malware, spam, or harmful content
- Attempt to gain unauthorized access to the Service's servers or infrastructure
- Resell, sublicense, or commercially exploit the Service without our written permission
- Use the Service in any way that violates WhatsApp's Terms of Service
Violation of these terms may result in immediate termination of your account without refund.
6. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
You retain ownership of all WhatsApp message content stored through the Service. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.
7. WhatsApp Compliance
WA Recall connects to WhatsApp using the WhatsApp Web protocol. You acknowledge that:
- WA Recall is not affiliated with, endorsed by, or sponsored by WhatsApp Inc. or Meta Platforms, Inc.
- Using WA Recall may be subject to WhatsApp's Terms of Service
- You are solely responsible for ensuring your use of WA Recall complies with WhatsApp's Terms of Service
- We are not responsible for any action taken by WhatsApp against your account as a result of using this Service
8. Intellectual Property
The WA Recall app, including its design, code, graphics, and branding, is owned by Pinchus Grosz and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the app.
9. Disclaimers and Limitation of Liability
9.1 Service Availability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that all messages will be captured. WhatsApp may change its protocols at any time, which could affect the Service's functionality.
9.2 Data Loss
While we take reasonable precautions to protect your data, we are not responsible for data loss due to server failures, network issues, or other technical problems. We strongly recommend enabling iCloud Backup as an additional safeguard.
9.3 Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of business, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason at our sole discretion.
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service will immediately cease. Your data will be deleted within 30 days of account termination.
Cancelling your subscription does not delete your account or data — it only stops future billing. To delete your account and data, you must explicitly request account deletion.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in New York, New York, except that either party may seek injunctive relief in court for intellectual property violations.
If you are a consumer in the European Union, you may also have rights under applicable EU consumer protection laws that cannot be waived by contract.
12. Apple-Specific Terms (EULA)
The following terms apply to your use of WA Recall obtained through the Apple App Store:
- These Terms are between you and Pinchus Grosz only, not Apple Inc. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support services for WA Recall.
- In the event of any failure of the app to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if applicable). Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
- You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. For significant changes, we will also send an email notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
